because as great and iconic as Ledger's performance was, truth be told his death took things to another level, perceptionwise.
yes, Ledger was legend as Joker and the movie was fantastic, but the controversy of his sudden death must account for great deal of the movies success. it deserved the success on the merits of the movie, but that's not what happened. which is an injustice to the film.
and Ledger deserved every award going but the truth be told if he had lived he wouldn't even get nominated. it was just other actors trying to do themselves homage that he got the Oscar, and that an injustice to Ledger also
