If only Homer's or Shakespeare's descendants had Ellison's lawyers (and greed). They'd be rich beyond belief.

Protecting intellectual property is important. But in the case of mild story resemblances the disincentive effects of having to share your income with whoever had a slightly similar idea before you surely dominates the disincentive effects of not wanting to be creative because somebody can steal your idea.
