I bet she will be confirmed.

I find all the "controversy" over her prior decisions to not really be controversial. She wasn't alone in her decision before the Supreme Court decided to take a look at it, and the Supreme Court itself was split in it's decision. It's not like the decision was unanimous.

The discussion turned political when someone commented on Sotomayor's "policy" statement...blah, blah, blah... "the courts don't...etc".

I could not resist making an argument which made it clear the courts HAVE made policy because laws are not always crystal clear and often times difficult to apply in modern context. If lawmakers don't like a judges ruling then they can go back and amend the law. Until that happens the court sets the policy for how that law is to be interpreted.

I was hoping to read some replies to that post. but I couldn't find the thread! The mods are much more picky lately.

Indeed, ordinary courts make quasi-law by their ruling. Otherwise, when laws were uberhuman perfect, we would not need courts to rule at all.

In short, a pretty dumb point against the nomination of this judge, but these nominations seem to be often drawn in the usual political mudfighting.
