Seriously for just a moment, I think Kirk would likely offer him the chance to stay on the ship but leave it to Cupcake to choose if he felt he could serve under Kirk's command. We don't know he didn't. If one of my team assulted a civilian (without dammed good reason) there would be a hearing, and if they were belived to have done the deed, there would be a court martial, or just a dishonrble dischage and let the civilan authorities have a crack at them.
