There's been some thought given in some circles about Charlie Evans being the possible villain, but outside of the fact Cumberbatch looks a bit old for Charlie, there's the part in the synopsis that indicates the villain was part of Starfleet (or at least the Federation)...

I'd make Charlie a low-on-the-totem-pole guess, but not outside the realm of possibility in the JJverse.

Robert April, who wanted the Enterprise and never got her? He wanted her in the beginning, but Pike won. Then he thought he'd get it after Pike, but then Kirk was chosen and April seeks revenge... XD

Charlie does not have to be a boy in this version. Maybe he's been a tool of section 31 having been discovered by the Antares and never met Kirk. Section 31 could have been using his talents for a number of years. Now Charlie's had enough and taking matters into his own hands.

Many have mentioned Section 31, but don't you think that's one of those things that JJ in his non-Trekness would think is way too fannish for his setting?

It would take too much time away from exploding planets and ship-swallowing black holes to explain what Section 31 is to the mostly non-Trek schooled audience.

Orci could potentially be smart enough to use something like Section 31, but I'm afraid JJ would likely axe such a thing.

Yeah, I don't think Section 31 and the concept of it would be too hard to grasp for the non-Trek audience really or wind into a story.

It's involvement is possible but unlikely for a TOS based story.
